Every policy and notice for this website lives here: privacy, terms, disclaimer, text messaging and cookies. Each starts with a brief summary in everyday language. If a summary and its full text ever differ, the full text controls.

Draft for review. Business details and legal review pending. The bracketed items below are placeholders to be completed and the text must be reviewed by a qualified attorney before it is relied on.

What we collect, why we collect it, who handles it for us, and the choices and rights you have, with a California section held for counsel.
Ground rules for using this site and working with us: what we do and do not provide, no guarantees, partner specialists and liability.
What our content, the estimator and our government contracting information can and cannot promise, and how partners are disclosed.
How we contact you, how you opt in to texts, how often, what it costs, and how to stop or get help with STOP and HELP.

This policy explains what personal information we collect through this website, how we use it, who else handles it, and what you can do about it.
This Privacy Policy describes how [Business legal name] (“OOTB”, “we” or “us”), which runs the Out of the Box Consultants website at [Website URL], handles personal information. It applies to visits to this site, our contact and booking forms, the free EBITDA estimator, any course waitlist, and the emails, texts and calls we exchange with you.
It does not apply to websites run by other organizations, including the government sites we point to. Those sites have their own practices. Please read our Terms and Conditions and Cookie notice as well.
We collect information in the following ways.
Please do not send us Social Security numbers, bank or card details, passwords or health records through our forms. We do not ask for them.
The estimator does its arithmetic in your browser. At the time of this policy it does not store or transmit the figures you type. They stay on your device and are gone once you close or refresh the page.
If we later add a way to save, email or submit a result, we will say so at that step, collect your inputs only if you choose to submit them, and update this policy before the change goes live. Please do not enter information about other people. The estimator is informational and is not an appraisal; see the Disclaimer.
Here is what we do with it:
We use GoHighLevel, a platform that also operates under the LeadConnector name, for our forms, scheduling, email and text messaging, and to keep our contact records. In privacy terms GoHighLevel is our service provider (a “processor”): it handles your information to provide those tools to us, under its own terms and privacy commitments.
[Counsel to confirm: that the GoHighLevel forms, calendar, email and text features are live before this section is published, and whether a data processing agreement is in place] We may add or replace providers over time and will keep this section current.
Our site and the tools it uses place small files on your device. Some are essential, for example to keep forms and the booking calendar working. Others may measure how the site is used.
You can control cookies in your browser settings and through [Cookie consent tool]. Details are in the Cookie notice.
We keep marketing consent apart from everything else. A contact request or a consultation booking does not sign you up for newsletters, promotions or marketing texts. Where we offer marketing, the form shows its own unchecked box, in plain words, and you can leave it empty and still send your inquiry.
Service messages, such as confirming a booking you made or answering a question you asked, are different from marketing. You can opt out of marketing at any time by using the unsubscribe link in an email, replying STOP to a text, or contacting us. We will honor an opt-out promptly. Withdrawing marketing consent does not affect messages about a consultation you have already booked.
We text you only if you have given us your separate consent to receive texts. The short version is below. The full terms are in the Communications and SMS Terms.
[Counsel to confirm: final text-message wording against GoHighLevel, carrier and registration requirements, and whether texting will be used at launch]
We share personal information only in these situations.
Selling personal information is not something we do. Nor do we hand it to others so that they can target you with ads based on your activity on other sites. [Counsel to confirm: this statement against the final analytics and advertising setup]
We hold information for as long as it serves the purposes above, meets a legal duty or helps settle a dispute. Our current plan is [Retention period] for inquiries and consultation records, until you opt out for marketing contact details, and as long as the law requires for anything else. After that we delete it or remove what identifies you.
We use reasonable measures to protect information, including secure connections to this site and limits on who can see records. No website or storage system is perfectly secure, so we cannot promise absolute protection. If a breach affects you, we will tell you as the law requires.
Depending on where you live, you may be able to:
To make a request, email [Contact email]. We may ask you to confirm who you are before we act, and we aim to answer within [Response time]. You will not be treated worse for using these rights.
[Counsel to confirm: whether the California Consumer Privacy Act, as amended, applies, and the exact wording of this section; add notices for other states as needed]
If California privacy law applies to us, this section will say that, in the last 12 months we may have collected identifiers (such as name, email and phone), business and inquiry details, and internet activity data; that we collect them from you and from the tools you use on our site; and that we use and share them only for the purposes described in this policy. It will confirm that we do not sell or share personal information for cross-context advertising and do not use sensitive personal information beyond what the law allows.
California residents may ask to know, correct or delete their information, and may opt out of sale or sharing. Requests go to [Contact email]. We will not retaliate against anyone who makes one. [Counsel to confirm: how we respond to browser opt-out signals]
Our services are for business owners and are not aimed at anyone under [Minimum age]. We do not knowingly collect information from children. If you believe a child has sent us information, contact us and we will delete it.
This policy may be revised. The current version is always on this page with its effective date. If a change is significant, we will give notice by email or on the site before it takes effect where the law asks us to.

These terms set the ground rules for using this website, booking a free consultation and working with us.
By using this site, booking a consultation or asking for our services, you accept these terms. If you do not accept them, please do not use the site. If you act for a company, you confirm that you may bind it. For paid work, a separate written agreement will apply, and where it conflicts with these terms, the written agreement wins. [Engagement terms, scope, fees and payment: to be added when services are priced]
We write plans and recommendations for established business owners who want to scale a business so it runs without them, build its value through EBITDA, value drivers and lower owner dependence, and be ready for what comes next. Government contracting is a secondary, newer area that we deliver through independent partner specialists.
Our work product is advice on paper. We do not carry out the plan, run any part of your business, broker or market a business, find buyers, advise on mergers and acquisitions, or give certified appraisals. We are not a law, tax or accounting firm.
We do not promise any outcome. That covers revenue, profit, growth, business value, a sale price, readiness for any future event, program eligibility, registration, certification and government contract awards. Results turn on many factors that neither of us controls, including the market, your team and your choices.
You decide what to do with any plan or recommendation, and you carry responsibility for those decisions and their results. You agree to give us accurate and complete information. We rely on what you tell us and do not audit it. Please take advice from your own lawyer, tax adviser, accountant or other qualified professional before you act on matters in their field.
Your first consultation is free and is held by phone or Zoom. It is a chance to talk about your goals and for us to see whether we can help. It carries no cost and no obligation for either of us. A conversation alone does not make you a client, and it does not create an advisory or professional relationship; that begins only when we both sign a written agreement. [Counsel to confirm: whether a confidentiality or non-disclosure term should apply to consultations]
Please keep confidential details to what is needed, and tell us in advance if you would like a call recorded, because we will record only with consent.
For some government contracting steps, we may introduce you to independent partner specialists. They are separate businesses. They are not our employees, agents or joint venturers, and they work under their own terms and prices. You are never required to use them, and we will not pass your details to one without your agreement.
As of the effective date, we have no referral or compensation agreements with these partners. If we enter into one, we will disclose it. We are not responsible for a partner’s services, advice or results. [Counsel to confirm: partner language once any partner arrangement exists]
The estimator is a free, informational tool. It multiplies the numbers and assumptions you enter and displays a range. The range is not an appraisal or a valuation, and it is not advice. Real value depends on many things a simple tool cannot capture, and it may be very different from what you see. Do not rely on it to buy, sell, price, finance, insure or report on a business. Details are in the Disclaimer.
We are planning a course. It is not yet available. Joining the waitlist is not a purchase and creates no obligation for you or for us. Topics, dates, format and price are not final, and we may change or cancel the plan. Separate terms will apply when enrollment opens. [Course terms to be added at launch]
The text, graphics, tools and other content on this site belong to [Business legal name] or its licensors and are protected by law. You may view the site and share links for your own business use. You may not copy, resell or republish our content without written permission. Plans we prepare for you are for your internal business use unless we agree otherwise in writing. If you send us feedback, you allow us to use it without owing you anything. [Counsel to confirm: who owns deliverables under a written engagement]
When you use this site, you agree not to:
We offer the site, tools and content on an “as is, as available” basis. To the extent the law allows, we give no warranty of any kind, express or implied, including about accuracy, completeness, fitness for a purpose or uninterrupted access.
To the extent the law allows, neither [Business legal name] nor its owners, staff or contractors will be liable for indirect, incidental, special, consequential or punitive losses, or for lost profit, revenue, business value or opportunity, from your use of the site, tools or services. Our total liability for any claim will not exceed [Liability cap amount or formula]. [Counsel to confirm: the cap, the carve-outs and whether these limits are enforceable in the governing state]
You agree to defend and reimburse [Business legal name] and its owners, staff and contractors for claims, losses and reasonable costs that arise from your misuse of the site, your breach of these terms or the information you give us. [Counsel to confirm: scope and enforceability]
The laws of the State of [State] govern these terms, whatever its conflict-of-law rules might otherwise say.
If a disagreement arises, we ask that you write to us first so we can try to settle it informally. [Counsel to confirm: whether to use mediation, arbitration or courts, and whether any class-action or jury-trial waiver is appropriate]
Intended structure for counsel to finalize: written notice, then at least [Days for informal resolution] of good-faith talks, then [Dispute resolution method] in [Venue: county and state]. [Counsel to confirm: consumer-protection limits that may apply]
We may update these terms and will post the new version here with a new effective date. If you keep using the site after a change, you accept the updated terms. A change does not alter a written agreement we have both signed.
If a court finds part of these terms unenforceable, the rest stays in force. Not enforcing a term at some moment does not waive it. You may not transfer your rights under these terms without our consent. These terms, with the Privacy Policy and Disclaimer, are the full agreement for use of the site.

This disclaimer explains what you can and cannot take from our content, our free estimator and our government contracting information.
The articles, guides, tools and conversations we offer are meant to help owners think through their business. They are general in nature and do not take account of your particular facts. Things change, so some information may be out of date by the time you read it.
Nothing on this site or in a consultation is legal, tax, accounting, investment or financial advice, and nothing is an appraisal, a valuation opinion or a fairness opinion. We are not a law firm, a CPA firm, an investment adviser or a certified appraiser. Speak with qualified professionals about your own situation before you make a decision.
The estimator shows a rough range by applying a multiple that you pick to an earnings figure that you enter. The multiple is your own assumption. It is not drawn from any market data on our side, and the estimator does not examine your records, your customers, your contracts, your risks or conditions in your market. The result is an estimate for discussion only. It is not an appraisal, it was not prepared by a certified appraiser, and it should not be used for a sale, loan, tax filing, insurance, legal dispute or any other formal purpose.
We do not know how any one business will do, and we do not track typical outcomes for a reason: there is no typical owner or business. Any example, figure or scenario we show is illustrative. Your results will differ and may be lower, or you may see none, depending on your effort, choices, team, market, finances and luck. Nothing we say promises revenue, profit, growth, business value, a sale price or readiness for any future event.
Statements about the future are opinions, not promises, and they carry risk.
We write plans and recommendations. We do not carry out implementation work, broker or market businesses, find buyers, advise on mergers and acquisitions, or provide certified appraisals. If you need one of those, please look for a qualified provider that offers it.
OOTB is not a government agency and has no affiliation with, endorsement from or special access to any government body. We cannot promise that you will complete a registration, receive a certification, qualify for a program or win an award. Agencies make those decisions under rules that change, and every opportunity has its own requirements.
Use the official sources for the real requirements: SAM.gov for federal registration and opportunities, the U.S. Small Business Administration (SBA) for small business programs and certifications, and the agency that issues each solicitation. Registering on SAM.gov is free when you do it directly with the government. Please be careful with anyone who asks for payment to do so on your behalf. [Counsel to confirm: wording about SAM.gov fees and the list of official sources]
For government contracting steps that call for specialist help, we may introduce you to independent partner specialists. They are separate businesses, not our employees or agents, and they set their own terms and prices. You are never required to use one.
As of the effective date, we have no referral or compensation agreements with these partners. If that changes, we will disclose it here and before we make an introduction.
We link to websites that we do not run, including government sites and tools from other companies. We do not control or endorse them, and we take no responsibility for their content or their handling of information. Following a link is at your own risk.
We may update this disclaimer and will post the new version here with a new effective date. Questions can go to [Contact email], or use our contact page.

These terms cover emails and text messages from us. They apply only if you have agreed to receive texts.
Messages come from [Business legal name], doing business as Out of the Box Consultants, through GoHighLevel (LeadConnector), our messaging provider. These terms add to our Privacy Policy and Terms and Conditions. [Counsel to confirm: whether texting will be used at launch; if not, remove this section]
Opting in happens when you give consent on one of our forms, or take another clear step we describe at that moment, such as texting a keyword. Consent is separate from your inquiry, and the box is never pre-checked. Wording on a form will be similar to this:
Yes, text me. I consent to text messages from [Business legal name] at the mobile number above. Frequency: [Message frequency]. Message and data rates may apply. Agreeing is optional and is not needed to book a consultation or buy anything. Text STOP at any time to cancel, or HELP if you need assistance. Read the Privacy Policy and the Communications and SMS Terms.
[Counsel to confirm: final consent wording, placement and any required links with counsel and the carrier registration]
We send emails for the same purposes. You can leave our email list at any time using the link in any message.
Message frequency: [Message frequency]. Expect more texts around a booked consultation.
We do not charge for texts. Your mobile carrier may charge message and data rates under your plan.
To end texts, reply STOP to any message. We will send one last message to confirm, and then no more texts from that number, including service texts. We will use email for anything about a booking. To get help, reply HELP or write to [Contact email]. If you opt in again later, we will start again.
Carriers and the networks they use are not responsible for late or undelivered messages, and we cannot promise that every message will arrive. Supported carriers: [Supported carriers].
We never pass mobile phone numbers, or the records of your text opt-in and consent, to outside companies or affiliates for their own marketing. We do give it to the providers who send the messages for us, and we disclose it when the law requires.
Please tell us if you change or give up your mobile number, so we do not reach someone else. If we learn a number now belongs to another person, we will stop texting it.
We may update these terms and will post the new version here with a new effective date. Questions can go to [Contact email].

A short note on the small files and similar tools this site uses.
Cookies are small files that a site places on your device. Similar tools, such as pixels and local storage, do comparable jobs. They help a site remember choices, stay secure and show how it is used.
Use your browser settings to block or delete cookies; the site’s essential features may then stop working. Where we offer [Cookie consent tool], you can change your choices there at any time. [Counsel to confirm: how browser opt-out signals are treated, and whether a consent banner is required]
We may update this notice and will post the new version here with a new effective date. Questions can go to [Contact email]. See also the cookies section of our Privacy Policy.
